On April 2nd, 2019, the case of Shandong Environmental Protection Foundation acted by Jin Rui v. Anshan Shengmeng Coal Gasification Co., Ltd. environmental pollution liability dispute, was held an appraisal agency selection meeting in Anshan Intermediate People's Court. And on the second day, Shandong Environmental Protection Foundation acted by Jin Rui v. China Hualiang Logistics Group Beiliang Co., Ltd. Dalian Thermal Power Company, China Hualiang Logistics Group Beiliang Co., Ltd. air pollution liability dispute, would be discussed and settled under the organization of the court....

 

From January 2016, China Environmental Protection Foundation v. Chongqing Chang'an Automobile Co., Ltd. air pollution liability dispute, to 2019, Jin Rui has been fighting in the field of environmental civil public interest litigation for three years. In the past thousand days and nights, Jin Rui has represented China Environmental Protection Foundation, Beijing Chaoyang District Friends of Nature Environmental Research Institute, and Shandong Environmental Protection Foundation to file environmental civil public interest litigations against more than 30 pollution enterprises, including Chongqing Chang'an Automobile Co., Ltd., Beijing Zhangyu Eiffelburg International Winery Co., Ltd., Sinopec Nanjing Chemical Industry Co., Ltd., Baotou Steel (Group) Co., Ltd., Shanxi Coking Group Co., Ltd. The litigation requests include ordering the above enterprises to stop the environmental damage immediately, eliminate the risk of environmental pollution immediately, restore the ecological environment to the state and function before the damage occurs, determine the cost of ecological environment restoration that the defendant should bear when failing to fulfill the obligation of restoration, and make public apologies to the public at the national media. By instituting environmental civil public interest litigation, the polluting enterprises are urged to upgrade their equipment as soon as possible to meet the environmental protection requirements, and to strengthen the governance of environmental pollution behavior and the restoration of the ecological environment. Taking the case of air pollution liability dispute between China Environmental Protection Foundation and Anhui Huaihua Group Co., Ltd. as an example, after the cost appraisal of air pollution improvement by appraisal agency, Anhui Huaihua Group Co., Ltd. finally agreed to invest 10.89 million yuan in improving Huainan environment according to the appraisal conclusion, and apologized to the public at  provincial media.

 

With the progress of society, people's awareness of environmental protection is also awakening. The report of the 18th National Congress of the CPC states that it is necessary to put ecological civilization construction in a prominent position and integrate it into all aspects and the whole process of economic, political, cultural, and social construction, striving to build a beautiful China and realizing the sustainable development of the Chinese nation. By 2018, the construction of "beautiful China" has been written into the Constitutional Amendment, which reflects the country's determined will to protect the environment. It is just at this important moment in history that Jin Rui, with our enthusiasm for environmental protection, have resolutely joined the team of safeguarding the blue sky and clear water, and have done our part in contributing to the beautiful China.
