On August 28th, 2018, a case acting by Jin Rui over profit distribution on behalf of a Huadian company was decided by the Xianyang Intermediate People's Court of Shanxi Province in the first instance, and  the total appeal of about 180 million yuan was supported by the court.           

 

In view of the defendant's failure to fulfill the effective judgment, Jin Rui recently acting on the Huadian company behalf applied for enforcement. According to the relevant legal provisions, during the enforcement, Jin Rui applied to the People's Court to seal up all bank accounts and the equity of other companies held by the company executed  , and demanded restrictions on the consumption of the legal representative. Finally, the company executed was forced to reach an enforcement settlement with the Huadian company, and agreed to pay about 18 million yuan to the Huadian company for the double interest on debt , in addition to the general interest on debt, according to the Interpretation of the Supreme People's Court on Several Issues concerning the Application of Law to the Calculation of Interest on Debt for the Period of Deferred Performance in the Enforcement Procedure.
